Terms of registration for a new member – purchase of a new subscription, subscription renewal and payment by credit card via the internet (on line)
PREAMBLE
Through our website (home gym.gr), our company, under the name "ZACHARIOU EIRINI" based in Lamia, Averof 47, with Tax Identification Number 302522759/D.O.Y.Lamias, G.E.MI. Number. 132753454000, provides you with the ability via the internet (on line) a) registering as a member of our network of gyms, b) purchasing a new membership and c) renewing your membership at a gym in our network, by paying the price via credit card.
The online purchase of the above services, as they appear each time on our website homegym.gr, as well as the payment of the price via credit card, is governed by these terms and agreements, which you must accept by selecting (by clicking) "click") the relevant field at the end of this with the indication "I unconditionally accept the above terms and agreements", in order to proceed and complete the relevant transaction. The unconditional acceptance of these terms and agreements is irrefutably presumed by the selection (by making "click") of this field. By accepting these terms and agreements and completing the information requested in the corresponding fields, it is irrefutably presumed that a valid contract has been concluded between us, as the company providing the services, and you, as a consumer, which is governed by the following terms and agreements:
I. SERVICES PROVIDED
The services provided by each Subscription - Offer are analyzed in detail on our website by selecting the corresponding field for each gym in our network, as well as the duration of use of each service (unlimited, etc.). Also, at the same point, any free services and any additional free time of use of our services beyond the contract, as well as additional services provided for a fee, are precisely separated.
II. TERMS OF PERFORMANCE OF THE CONTRACT, PLACE, METHOD AND TIME OF PROVISION OF SERVICES
The commencement of the contract is possible upon fulfillment of these terms and conditions. The above services will be provided during the gym's operating hours and at the times provided for in the daily program (e.g. group programs). Our company reserves the right, without justification and without notice, to modify the operating hours, as well as the daily program, of either one of the gyms or all of the gyms.
The services will be provided exclusively to you personally and not to a third party.
When using the gym, you must respect the gym's internal operating regulations, which are also listed in detail on our website and which it is irrefutably presumed that you know and accept unreservedly upon concluding the contract.
You are also required to notify the Company and the gym you choose to subscribe to of any medical problems or specific conditions you may be experiencing, as well as to provide the medical examinations and certificates that will be requested of you during your first visit, bearing sole responsibility in the event of concealment of health problems or medical recommendations/warnings regarding partial or total prohibition of gym use.
III. PRICE
The total price for the services provided with each Subscription is listed in detail on our website. This amount includes the Value Added Tax (VAT), as applicable in each period, the corporate income tax, as applicable in each case, as well as the fee (commission) of the company "VIVA PAYMENT SERVICES S.A.", as applicable in each case, which undertakes the processing of the payment of the price, via credit card, under the terms below.
By accepting these terms, acceptance of the price as fair, reasonable and proportionate to the services provided is irrefutably presumed.
The prices - offers will be valid exclusively for the time indicated on our website.
For new members, a registration fee of €20 will be added to the currently listed subscription cost. The amount corresponding to the registration fee is paid once for each person-subscriber and concerns our entire network of gyms.
IVPAYMENT METHODS
The payment of the above price, both for Subscriptions and new member registrations, is made in a one-time payment, as it is a special agreement that works for the benefit of the consumer (preferential price, unlimited use of some services, free services, free months of subscription).
The payment of the price is made via credit card. The process is carried out and completed through the limited liability company "VIVA PAYMENT SERVICES S.A.", with which we cooperate. It concerns all credit cards for which the above cooperating company provides its services.
The transaction process takes place as follows:
The consumer, after being transferred to our website, initially completes the necessary information for opening his account, in the environment of our website and specifically completes in the corresponding fields a. NAME, b. LAST NAME, c. PHONE, d. e-mail. He then selects the gym that interests him and the corresponding subscription. Then, and after accepting these terms and agreements, he is automatically transferred to the environment of the collaborating company "VIVA PAYMENT SERVICES S.A.", where he provides the requested information, as well as his credit card information, either electronically or by telephone, by calling the collaborating company and the telephone number 801 3003 800. The credit card is charged with the amount corresponding to the subscription and the gym that has been selected. After the transaction is completed, the consumer will receive two electronic messages (e-mails), one from our company to confirm the purchase of our services and one from the collaborating company "VIVA PAYMENT SERVICES S.A." to charge the credit card.
The contract concluded above between us, as the company providing the services, and you, as the consumer, is subject to the resolutive condition of the successful completion of the above credit card charging procedure, which is carried out entirely in the environment of the company "VIVA PAYMENT SERVICES S.A.".
The above process is completely secure and at no stage is the customer's credit card information disclosed to us or to any third party, except for the above company which is authorized to process homegym.gr's online transactions.
The customer's credit card will be charged only once. Subscriptions are not automatically renewed upon expiration.
The relevant document (Proof of Service Provision or Invoice) will be received by the consumer during his first visit to the gym he has chosen.
In the event that the customer does not receive the relevant documents, he must complain in writing to our company within one month from the date of submitting a purchase request through our website, otherwise it is irrefutably presumed that he received the relevant documents.
V. RIGHT OF WITHDRAWAL - CANCELATION (Based on Law 2251/1994 on Consumer Protection)
A. RIGHT OF WITHDRAWAL
The consumer has the right to withdraw from the contract without giving any reason within fourteen (14) calendar days from the day following receipt of the original contract, in accordance with the above. The exercise of the right of withdrawal by the consumer takes place within the aforementioned period by submitting a simple letter to the gym by the consumer. The withdrawal is submitted either in person, or by fax, or by registered letter to our gyms (the one chosen), provided that the registered letter was sent within thirty (14) calendar days.
B. RIGHT TO COMPLAINT
The consumer is entitled, for a good reason, at any time during the contract, even after the expiry of the period set out in the previous paragraph, to terminate the contract, before the end of the agreed program. In this case, and given that this is a one-time payment for which a relevant document is issued, which is subject to VAT and corporate income tax, after deducting these amounts, as well as the fee of the cooperating company "VIVA PAYMENT SERVICES S.A.", the amount corresponding proportionally to the operating time of the contract must be withheld from the remaining amount. The remaining amount will be returned to the consumer after withholding, in accordance with the relevant legislative provisions, an amount corresponding to 2.5% on the value of this unexecuted program as compensation.
C. TERMINATION OF THE CONTRACT BY THE COMPANY PROVIDING THE SERVICES
Our company has the right, in the event of a violation of its internal operating regulations as well as in the event of a violation of any of the terms hereof, all of which are considered essential, as well as in cases of force majeure, extraordinary and unforeseen circumstances, to terminate this contract unilaterally and without penalty at any time.
VI. TRANSACTION SECURITY – PERSONAL DATA PROTECTION
Since all transaction data is entered into the environment of the cooperating company "VIVA PAYMENT SERVICES S.A.", the company is responsible for their encryption, which, according to what is stated on its website, www.vivapayments.com is a payment institution licensed by the Bank of Greece, which has received PCI-DSS certification and implements the required security policy, which is evaluated through continuous audits by a certified security auditor. Viva does not store customer credit card data in its systems. All data is transmitted encrypted to the cooperating Banks. The personal and confidential data of Viva customers is stored only in encrypted form in Viva's systems, without a direct connection to the internet. To ensure the confidentiality of data transfer, they use the EV SSL-128bit encryption protocol. The system has been implemented in collaboration with the company Thawte, which specializes in transaction security issues.
IMPORTANT SAFETY INFORMATION
Under no circumstances will homegym.gr ask you for your credit card details by e-mail or send you an e-mail asking you to go to the website and enter your card details.
Under no circumstances should you disclose your credit card details in an e-mail or respond to e-mails that ask you to visit a website to enter your card details.
Regarding the information that you must fill in on our website (name, surname, telephone number, e-mail), providing them by you by completing the corresponding fields implies the simultaneous provision of your consent for their collection and processing by homegym.gr, in accordance with the New Personal Data Protection Regulation (EU) 2016/679 – Regulation (EU) No. 679/2019 of 27of April 2016 (GDPR).
VII. DISPUTE RESOLUTION – JURISDICTION
For any dispute arising from this and the concluded contract, the possibility of out-of-court dispute resolution is provided by appealing to the Amicable Settlement Committees or the Consumer Ombudsman.
In any case, the courts of Lamia are designated as competent to deal with any dispute that may arise from this and the contract drawn up.

Gym Internal Regulations HomeGym
- Registration in the gym is only allowed to adults. Minors under 13 years of age, with or without an escort, are strictly prohibited from entering the adult fitness areas (group rooms, free weights, strength machines). The gym does not provide a babysitting service. Registration of minors as members is possible only with the consent of the guardian or in person by the minor, provided that a responsible declaration of the guardian is presented for the registration of the minor as a member and the approval of the terms of these regulations.
- Each member is required to provide a medical certificate from a Cardiologist or Pathologist upon registration, confirming the member's ability to exercise. In case the certificate is not presented within one month of the activation of the membership, the gym reserves the right to deny entry to the member until it is presented. A corresponding certificate must be presented every year.
- Upon registration, the gym issues a Digital card via the gym's App. Upon entering the gym, members are required to display the Digital card on the special identification device (barcode) located at the gym's reception.
- During the registration of the member, the reception staff will request his/her photograph, as a necessary element, to complete the identification of the details. In case of refusal, the member must bring, in addition to the membership card, another document proving his/her identity, which contains a photograph of him/her (e.g. police ID, passport, driver's license, etc.), which he/she must show to the reception staff, in order to be allowed entry into the gym.
- After registering at the gym, the member will receive printed or electronic instructions on how to exercise with the help of the trainers, followed by a free interview with the trainer in charge of the shift.
- The behavior and presence of members in the gym must always be polite and dignified.
- Members should use all gym equipment with caution and always follow the instructions of the trainers.
- The return of equipment (dumbbells, plates, mats, etc.) to the designated location is mandatory for all members.
- Appointments and priority for Extra services are arranged by prior arrangement only. In case of cancellation less than 2 hours before the scheduled time, the member will be charged for the appointment.
- Members are prohibited from bringing bags and sports bags into the gym (cardiovascular machines, free weights, group rooms, etc.). Lockers must be used for the temporary storage of personal items, and members are only allowed to use them during their stay in the gym. It is expressly prohibited to keep the lockers locked after using the gym and leaving the members. After the gym's daily operation, the gym may, without prior notice, unlock and empty all lockers in the locker rooms, excluding any liability for the loss of items.
- Smoking is prohibited in all areas of the gym.
- The use and trafficking of illegal substances and dietary supplements within the gym is strictly prohibited.
- It is prohibited to create noise in the area and disturb members.
- Members are responsible and must take care of their body hygiene while in the gym and always change clothes after sweating heavily.
- The use of a towel is mandatory on all machines where there is physical contact.
- The use of athletic clothing and athletic shoes is mandatory.
- The use of mobile phones is prohibited during group programs.
- Members are expressly prohibited from providing services that compete (Personal Training) with the gym's services.
- It is prohibited to enter the Sauna with clothes and valuables.
The time spent in the Sauna, the frequency of use and the temperature must be arranged in consultation with the HomeGym managers. - Showering is required before using the Sauna, swimming pool, Turkish bath and Solarium. The use of sunscreen products is prohibited in the Solarium.
- The member must take into account the building's safety measures to avoid accidents.
- The restoration of any damage to an object located in the Gym area caused by fault is the responsibility of the person who caused it.
- The gym is not responsible for the loss of money or personal belongings of members from the gym premises, nor from the locker rooms.
- The gym does not provide a storage service for members' personal belongings and under no circumstances is their safekeeping provided by the reception staff.
